AP Issues Takedown Notice to AP Affiliate for Embedding AP YouTube Videos

As we know from last year's dust-up over fair use of AP articles, AP doesn't really understand the word fair. And it appears, AP doesn't understand the word affiliate, either (or YouTube, for that matter).

From the AP:

Yan said a WWF Donsol Project Manager Elson Aca took pictures of the megamouth and tried to dissuade the fishermen from eating it. Shark meat is the main ingredient in a local delicacy.

Fujimori Gets 25

Fujimori: Los titulares de la condena by javi270270.

Alberto Fujimori, former president of Peru, was convicted Tuesday of "crimes against humanity" and received a 25 year sentence for his role in murder and kidnappings committed by death squads in the government's campaign against leftist "Shining Path" guerrillas.

Human rights groups call the ruling a precedent-setting verdict that upholds the internationally-recognized principle that violent abuses must not be committed in the name of fighting terrorism.

From the Washington Post:

Many people in Peru admire Fujimori for largely defeating the Shining Path insurgency and ending a two-decade war that left about 70,000 people dead. But the tribunal found that Fujimori was guilty of creating and authorizing a military intelligence death squad that killed innocent people.

(...)Fujimori's trial focused on two episodes of killings: a 1991 raid in which 15 people, including an 8-year-old boy, were killed at a barbecue in Lima where the military intelligence unit was looking for Shining Path suspects. This raid, which became known as the Barrios Altos massacre, was followed by the 1992 abduction and killing of nine students and a teacher from La Cantuta University, also by the Colina Group.

Fujimori was also accused of ordering the kidnappings of journalist Gustavo Gorriti and businessman Samuel Dyer in 1992.

One of the arguments Fujimori partisans sometimes offered was that the dead had been terrorists and that their deaths were, therefore, justified. But the tribunal wrote in the summary of the 711-page sentencing document that none of the 25 people killed in the two massacres had been members of the Shining Path.

Privacy Claim Based on Republication of Web Posting Is Rejected

Those assholes who threaten others with 'copyright violations' might want to take heed ...
Comments posted on a publicly accessible website are not private and the poster cannot sue for invasion of privacy when the comments are republished, according to a California appellate court.

California’s 5th District Court of Appeal last week affirmed a Fresno Superior Court judgment, which rejected a claim from a UC Berkeley student, whose MySpace.com page included a phrase that she “despise[d]” her hometown of Coalinga.

The case is of significant interest because it emphasizes the obvious in the court of law: Anything one posts can and will be used against them.

Cynthia Moreno posted her 700-word “Ode to Coalinga” on her MySpace page after visiting the town of 19,000 residents midway between Sacramento and Los Angeles.

She began by saying “the older I get, the more I realize how much I despise Coalinga,” and then made several negative comments about the town and its inhabitants.

The entry was posted only six days but was long enough for Roger Campbell, principal of Coalinga High School, to find the story and forward it to the editor of the Coalinga Record. Her ode was published in the newspaper’s letters section.

Local reaction was harsh, according to the suit, and included death threats and a gunshot fired at her family’s home.

Her father’s 20-year-old business — which wasn’t identified in the complaint — lost so much money that it was closed, the suit claimed, and the family moved out of town.

Moreno and her family sued Campbell, the Coalinga Record and the Coalinga-Huron Unified School District, alleging invasion of privacy and intentional infliction of emotional distress.

The publisher was dismissed from the suit, and eventually Fresno Superior Court Judge Adolfo Corona sustained demurrers dismissing the complaints against the remaining defendants.

In Thursday’s decision, 5th District Court of Appeal Justice Bert Levy wrote that “once posted on MySpace.com, this article was available to anyone with Internet access.”

“The facts contained in the article were not private,” ruled Levy, who noted that Moreno’s “potential audience was vast.”

“Cynthia’s affirmative act made her article available to any person with a computer and, thus, opened it to the public eye,” Levy wrote. “Under these circumstances, no reasonable person would have had an expectation of privacy regarding the published material.”

Levy said that her comments to be republished did not constitute intentional infliction of emotional distress because it was not outrageous conduct as a matter of law.

Putting meat back in its place

LET’S suppose you’ve decided to eat less meat, or are considering it. And let’s ignore your reasons for doing so. They may be economic, ethical, altruistic, nutritional or even irrational. The arguments for eating less meat are myriad and well-publicized, but at the moment they’re irrelevant, because what I want to address here is (almost) purely pragmatic: How do you do it?

I’m not talking about eating no meat; I’m talking about cutting back, which in some ways is harder than quitting. Vegetarian recipes and traditions are everywhere. But in the American style of eating — with meat usually at the center of the plate — it can be difficult to eat two ounces of beef and call it dinner.

The Knack

Cop beats and kills innocent man

A London cop charged Ian Tomlinson, an innocent bystander at the G20 demonstrations who was on his way home from work, who was walking peacefully with his hands in his pockets, clubbing him and throwing him to the ground without provocation. Shortly after, he suffered a fatal heart attack. Does anyone believe that Tomlinson was the only person who was attacked without provocation by the police that day?

Dramatic footage obtained by the Guardian shows that the man who died at last week's G20 protests in London was attacked from behind and thrown to the ground by a baton-wielding police officer in riot gear.

Moments after the assault on Ian Tomlinson was captured on video, he suffered a heart attack and died.
